NRA, SAF, NSSF Sue New Mexico Again Over 7-Day Gun Waiting Period After Court Defeat

On October 19, 2026, NSSF, SAF, NRA and six other parties sued Attorney General Raúl Torrez in New Mexico federal court to block ongoing use of a seven calendar day delay on taking firearms. Officials had said they would keep applying House Bill 129 to nearly all buyers after the Tenth Circuit held the delay unconstitutional for people who already pass federal background checks. A later district judgment covered only Samuel Ortega and Rebecca Scott, so everyone else still faces the wait. The 2024 statute requires that pause even after instant approval, with narrow exemptions for certain licensees, officers, dealers and relatives. Plaintiffs seek wider injunctions for members, customers and businesses plus fees.
