Albany County probation staff ordered a new presentence report for Demetrio Daga, keeping him in the county jail while sentencing shifted from late October to November 30. Officials supplied no reason for discarding the earlier report that recommended probation without added jail time for the 44-year-old Albany man who is married with two children.
A jury convicted him on all 15 felony counts in late August 2026 after a seven-day trial tied solely to New York bans on unserialized privately made firearms. Searchers recovered 3D printers, unserialized handguns, AR-style rifles, serialized long guns, frames, receivers, magazines, and ammunition at two linked homes, but prosecutors showed no crime use, sales, or injuries and he had no prior record. Judge Andra Ackerman may decline the no-jail advice for a long prison term even as lawyer Kevin O’Brien noted the original review found prison unnecessary.
