The Supreme Court declined to hear a challenge to Maine’s 72-hour delay on firearm transfers, so the statute remains in force for now. A district judge had blocked the measure in Beckwith v. Frey, yet a First Circuit panel reversed after finding the delay only conditions sales and does not involve Second Amendment rights. The suit will still move toward a final district-court judgment.
A split exists because the Tenth Circuit blocked New Mexico’s seven-day wait, and that state did not seek high-court review. Maine’s attorney general waived a response on September 24, and no justice asked for a filing.
