NSSF Challenges New Mexico’s ‘Rights Delayed’ Seven-Day Waiting Period After Governor Ignores Court Rulings Declaring It Unconstitutional

NSSF sued New Mexico’s top prosecutor to block a week-long hold on firearm sales after buyers already pass the federal instant check. Two federal rulings have already said that hold violates the Second Amendment for law-abiding people who receive a proceed.

The Tenth Circuit decided last year that the delay stops lawful acquisition, then a district court entered summary judgment and a lasting injunction limited to the original plaintiffs. State officials are appealing once more and intend to apply the rule anyway, including to licensed dealers outside that first lawsuit. The trade group brought this new case so its retailer members would be covered.
