NRA, Partners File Another Federal Lawsuit Challenging New Mexico’s Waiting Period Law

The National Rifle Association and National Shooting Sports Foundation joined other groups in filing NSSF v. Torrez against New Mexico’s seven-day waiting period on firearm transfers after a background check is passed.

The case follows Ortega v. Grisham, where the 10th Circuit Court of Appeals held the waiting period violates the Second Amendment, yet officials treat that decision as limited to two plaintiffs and keep enforcing the law.

Additional plaintiffs include the Second Amendment Foundation and NRA member Peter Hackett. They ask the court to declare HB129 unconstitutional for sales after a federal background check and to stop enforcement against them, their customers and members.
