Florida AG Declares Short-Barreled Rifles and Shotguns Legal Without NFA Registration or Tax Stamps

Florida Attorney General James Uthmeier on November 6, 2026 directed law enforcement and prosecutors that law-abiding Floridians may possess short-barreled rifles and short-barreled shotguns without NFA registration, ATF approval, or tax stamps. He based the conclusion on Florida Statute § 790.221’s exemption for firearms lawfully possessed under federal law after the One Big Beautiful Bill Act zeroed NFA taxes, the August 5, 2026 Silencer Shop Foundation v. ATF ruling, and ATF’s October 9 halt to nationwide enforcement. The memo states mere possession does not supply reasonable suspicion or probable cause, his office will not defend such convictions on appeal, and § 790.33 preempts local extra restrictions. Remaining federal limits include Gun Control Act requirements, prohibited possessors, Form 20 interstate transport, and NFA rules for machine guns and destructive devices.
