The Fifth Circuit in Knife Rights, Inc. v. Blanche, with financial support from the NRA Civil Rights Defense Fund, reversed the 15 U.S.C. § 1242 dismissal and remanded, holding 1958 interstate switchblade restrictions violate the Second Amendment as protected arms for self-defense and lawful uses with acquisition included. Bruen analysis found the government failed its burden, with only two of nearly 200 historical statutes comparably limiting manufacture, transportation, or distribution rather than concealed carry. Dismissal of the facial 15 U.S.C. § 1243 challenge was affirmed because it was not shown to lack all constitutional applications.
