A federal judge issued a permanent injunction that bars New Mexico from applying its seven-day firearm-transfer waiting period to the two plaintiffs in the case. The National Rifle Association described the ruling as a win.
John Commerford, executive director of the NRA Institute for Legislative Action, welcomed the outcome. State Representative Stefani Lord said she was not celebrating and urged people to examine the judgment itself, noting that the Tenth Circuit had already rejected the waiting-period statute.
Kostas Moros of the Second Amendment Foundation said current law limits such injunctions to the named parties after the Supreme Court’s CASA decision, yet anyone later charged can cite the circuit precedent and may sue an official who tries to enforce the statute against them.
