Several Second Amendment groups have sued New Mexico again because officials still apply a seven-day firearm purchase delay that two federal courts already held unconstitutional.
The National Shooting Sports Foundation leads the case with the Second Amendment Foundation, the National Rifle Association, two state industry associations, two retailers, another rights group, and private citizen Peter Hackett.
A 2024 statute still requires that week-long hold even after a buyer clears a background check. An appeals judge more than a year ago found the delay likely unconstitutional, District Judge James Browning agreed in August, and the attorney general then appealed once more, prompting the new filing.
