Texas Suppressor Manufacturer Files Lawsuit Challenging Federal Gun Control Act Of 1968

Jared Gee and David Abt, who run Texas suppressor firm 1836 LLC, sued the Justice Department on October 9 in northern Texas federal court, attacking 1968 Gun Control Act license rules for suppressors built and sold only inside Texas on the ground that Congress overstepped the Commerce Clause.

Texas Gun Rights, whose members include the pair, said ATF agents in August 2024 seized suppressors, display guns, stock and electronics from their Fort Worth hunting-show booth, then searched homes and shops, with no indictment issued at the time. They had operated under a 2021 Texas statute now coded as Government Code 2.052 that treats wholly local suppressors as beyond federal commerce power, though Washington still applies federal firearms law, and they estimate license paperwork could consume a third of work hours while asking the court to bar federal involvement in such in-state products.
