Sheldon Whitehouse’s broadside against Acting Attorney General Todd Blanche on CNN is the latest reminder that the institutional left views any deviation from its preferred enforcement priorities as an existential threat. Whitehouse’s claim that Blanche is “affirmatively committing wrongful acts” simply for refusing to weaponize the Justice Department against lawful gun owners and Second Amendment–supporting organizations is a transparent attempt to reassert the narrative that the only legitimate use of federal power is to restrict rights, not protect them. In practice, Blanche’s approach—prioritizing violent offenders over paperwork violations and declining to pursue novel theories that criminalize common accessories—represents a return to neutral law enforcement rather than the selective prosecutions that defined the prior administration.

For the 2A community this episode is instructive: it shows how quickly the same voices that spent years celebrating ATF rule-by-letter and expansive interpretations of “engaged in the business” will label restraint as misconduct. Whitehouse’s rhetoric also telegraphs the legislative and litigation strategy Democrats intend to pursue if they regain unified control—reviving magazine bans, universal background checks, and red-flag regimes through DOJ guidance rather than statute. Gun owners should therefore treat every confirmation hearing and every budget fight as a referendum on whether the Justice Department will once again be used as an instrument of policy rather than an enforcer of law.
