Federal Judge Rules Against New York: Body Armor Ban Violates the Second Amendment

Listen to Article

A federal judge in the Western District of New York struck down the state's prohibition on body armor on Wednesday, holding that the measure conflicts with the Second Amendment. The ban had been enacted by Democratic lawmakers after the Supreme Court's Bruen ruling as they pursued additional firearms restrictions.

Judge John Sinatra considered Bruen along with Heller and McDonald and concluded the law cannot stand. The Firearms Policy Coalition joined the suit as a plaintiff, and its president Brandon Combs said the group had previously prevailed against restrictions on semiautomatic rifles and now showed that body armor for defense falls under the Second Amendment.
