Palmetto State Armory on October 23, 2026 opened ship-to-dealer sales of eligible short-barreled rifles in 17 states after a federal injunction and ATF non-enforcement of some National Firearms Act registration rules. As a plaintiff in Silencer Shop Foundation versus ATF, the company is covered by Judge James Wesley Hendrix’s August 5 holding that zeroed taxes left those registration and approval rules beyond Congress’s taxing power for suppressors, short rifles, short shotguns, and certain other weapons. The Justice Department will not appeal, and ATF on October 9 applied non-enforcement nationwide, though a later administration could reverse policy while the injunction remains binding unless a court changes it. Dealer transfers and background checks still apply, state limits can block sales, the statute is unrepealed, machine guns stay restricted, and the decision did not finally resolve Second Amendment claims.
