Ninth Circuit Rejects California, Giffords Bid to Expand ATF ‘Ghost Gun’ Rule

The Ninth Circuit just handed the gun-control crowd a stinging reminder that federal courts aren’t rubber stamps for policy wish lists. California and the Giffords group wanted the ATF to stretch its “ghost gun” rule so far that even an unfinished hunk of aluminum would count as a firearm. The three-judge panel didn’t buy it; they ruled the plaintiffs lacked standing because they couldn’t show any concrete injury from the agency’s refusal to regulate blanks that still require substantial machining. In plain English, the court told the anti-gun coalition it can’t sue its way into rewriting federal law when the statute itself draws a bright line between a finished receiver and raw metal.

That line matters more than most people realize. The ATF’s 2022 rule already pushed the definition of “firearm” to its statutory limit by sweeping in partially complete frames and receivers sold with jigs or templates. California’s ask would have erased the line entirely, turning every piece of bar stock into a regulated item and forcing hobbyists, 80-percent builders, and even machine shops into a paperwork maze. The Ninth Circuit’s refusal to play along keeps the focus where it belongs: on actual firearms, not on the raw materials from which they might someday be made.

For the broader Second Amendment community the decision is both a tactical win and a strategic warning. It shows that even in a circuit often hostile to gun rights, judges will still demand real-world harm before they let activists rewrite statutes from the bench. At the same time, it underscores how relentless the regulatory pressure has become—every unfinished receiver, every jig, every drill press is now a target. The ruling buys time, but it also signals that future battles will be fought over the meaning of “readily convertible” and “substantial effort,” not just over the finished product.
